High Court halts SOCU’s charges against Ali

first_img…stay granted pending Fixed Date Application proceedingsChief Magistrate Ann McLennan has been temporarily barred from hearing the 19 charges brought against former People’s Progressive Party/Civic (PPP/C) Housing Minister Irfaan Ali by the Special Organised Crime Unit (SOCU) last November.PPP Executive Member and former Housing Minister Irfaan AliFollowing appearances by the interested parties on Thursday, High Court Judge Franklyn Holder granted a stay of Magistrate’s Court proceedings regarding Ali’s application that challenges the legality of the charges proffered by SOCU.SOCU implicated Ali for conspiracy to defraud contrary to common law which relates to the sale of lands at Plantation Sparendaam, East Coast Demerara (ECD). The respondents to Ali’s application are Police Commissioner Leslie James and Chief Magistrate Ann McLennan who are represented by the Attorney General Chambers while Prosecutor Tashanna Lake is representing the Director of Public Prosecutions (DPP)Shalimar Ali-Hack. State Counsel Leslyn Noble is appearing for Police Detective Corporal Munilall Persaud.During Thursday’s in-chamber proceedings, Noble reportedly contended that the charges against Ali are known to law under Section Three of the Criminal Law Offence Act. “We submitted that the applicant Irfaan Ali’s application is an abuse of process; it is premature as the application in itself has no merit,” Noble stated.The press was told the High Court found that the issues regarding particulars of the offence are “reasonable issues to be tried”. This is related to whether a valuation ought to be obtained before purchase of land. One of Ali’s lawyers, Anil Nandlall, who also appeared before Justice Holder, disputed the merit of Noble’s arguments, stating that there is no section of the law that criminalises the lack of a property valuation when selling a property.“One of our grounds is not that the charges are unknown to law, but the particulars, even if they are able to prove them, do not constitute an offence known to the criminal law of this country. Selling property without a valuation has never been a criminal offence,” Nandlall opined following proceedings.He further outlined that the DPP submitted a “sworn affidavit” saying that she did not advise on the charges which Nandlall views as an integral aspect of the case. In that affidavit, seen by this newspaper, Ali-Hack, while denying much of the applicant’s contentions in his writ, stated, among other things, that she did not advise on the charges, contending that the DPP “is not a proper party”.She outlined that being a co-owner of a house lot; she thought it best that no member of staff of the DPP’s office advise on the matter to prevent the appearance of bias.The FDA application will be heard on February 5. On February 6, the Magistrate will have to be informed of the High Court’s decision to stay the matter pending the outcome of the FDA case.In the writ filed by Ali, he posits that the charges are “irrational, arbitrary, capricious, whimsical, malicious, biased, without any proper evidential basis, made in bad faith, influenced by irrelevant and improper considerations and motives, unreasonable, discriminatory, unlawful, null, void and of no effect”.The application sought two orders of Certiorari – the first one quashing the decision of the DPP to charge him with the offence of Conspiracy to Defraud Contrary to Common Law and the second, to quash the oath of Corporal Persaud, given at the Georgetown Magistrates’ Courts regarding the 19 charges.The applicant is seeking to secure a declaration that the particulars of the charges do not constitute an offence known to law and contravene Section 144 (4) of the Constitution and the fact that there is no statutory or common law that requires a valuation prior to the sale of property.“I deny selling any lands to any persons. Moreover, assuming arguendo that the facts as alleged in the charges are true, which is denied, I have been informed by counsel and verily believe that the particulars as contained therein do not amount to any offence known to law, which even if proven, are impossible to yield a conviction for the offences charged,” an excerpt of the case file read.He has also highlighted that the charges have been laid nine years after the fact, stating that the case is deleterious to him. The Dons defense made two goal-line stands to prevent Compton from getting into the end zone and senior running back Elijah Wesson rushed for 118 yards and two touchdowns on 13 carries in a 32-0 win over the Tarbabes at Dominguez High. The loss was the first for Compton (4-1) this season while the Dons, who entered the game ranked second in CIF Southern Section Division III, improved to 4-1. “Our defense played well tonight and I thought those two goal-line stands were the turning point,” Dominguez coach Willie Donerson said. “Also, I thought our running game did an excellent job and I thought we wore them down in the second half.” “Plain and simple, they outplayed us. This was their night but we’ll be fine and we’ll be ready for Jordan next week.” Wesson added an 11-yard touchdown run with 9:57 left in the third quarter to extend Dominguez’s lead to 19-0 but with four minutes left in the game, he had to leave with a knee injury and did not return. “It’s just a bruise,” Wesson said. “I fell on it but I’ll be ready to go next week against Downey.” Brandon Johnson also rushed for 88 yards on 11 carries for the Dons while Marvin Johnson threw a 66-yard touchdown pass to Richard Sherman late in the fourth quarter. Mbeki to mediate between ICC, Sudan

Bashir has rejected the arrest warrant. During the session, the AU’s Sudanese ambassador, Mohieldin Ahmed Salim, called on all AU members to withdraw from the ICC, by pulling out of the Rome Statute that established the world’s first permanent war crimes court, in protest against the warrant. “South Africa has never countenanced any acts of impunity,” Dlamini-Zuma told journalists. “However, South Africa supported the decision of the AU to defer the issuing of the warrant of arrest against President Bashir by a year to give the peace processes in the Sudan a chance.” According to the UN, the decision will, if implemented, cause irrevocable damage to humanitarian operations there. UN Secretary-General Ban Ki-moon has meanwhile appealed to Sudan to reconsider its decision, taken in response to last week’s arrest warrant announcement, to fire 13 international aid groups aiding an estimated 4.7-million people in Darfur. AU special session The African Union (AU) has appointed former South African president Thabo Mbeki to chair a committee to investigate human rights violations in Darfur, as well as to mediate between the International Criminal Court (ICC) and Sudan. Take a hypothetical situation that many corporate video producers face from time to time: you have a client, you have a concept, but you need a way to tie everything together to keep the messaging on point. You can use on-screen text, but that can get boring. You can also use talking-head interviews with corporate spokespeople, but those can be unreliable.A common solution to just about all corporate video messaging problems is adding voice-over narration. While you should never over-use it or rely on it as a crutch to present information, it can be quite practical, and it can give your video a clear voice and direction. Let’s look at these seven tips for finding voice-over talent, getting quality audio recording, and creating dynamic corporate videos that your clients will love.1. Script and ApproveWhen working in corporate video, the client reigns supreme. Yes you could probably make a killer corporate video on your own with no input, but the industry seldom works that way. You need to maintain consistent and clear communication with your clients throughout the process — and nowhere is that more important than in pre-production and scripting.Before you can record your voice-over, you’ll need a script that is planned-out, drafted, revised, reviewed, and signed-off on by your client. If other agencies are involved, make sure they’ve seen the script and have given their approval before you proceed. Even if you can pass the bill along, it’s not in anyone’s best interest to have to re-shoot or re-record down the line.2. Start with In-House TalentImage via Tsian.One trick I learned working on my fair share of corporate voice-over videos is to start with your in-house resources. If you’re confident in your own voice, it can help if you simply record your voice-over track yourself. This will not, and should not, be the final tracking, but it will help you as you begin to lay out your storyboard and shooting schedule. You can check for any awkward phrases, as well as a get a good idea of timing and pacing.3. Consider ProfessionalsOnce you’ve laid out your dummy track, you can begin building out the rest of your video around it. When you’re comfortable with the fit and tone of your voice-over, you can look at other resources. Professional voice-over actors are great, and (if you have the budget), bringing one in-house to record is always the best approach. You can find voice-over actors through talent agencies or other local resources, and you can make casting decisions based on the particulars of your project.4. When working with online services, always make sure that they offer RAW recording files. If they’re sending over .mp3s that only take a few seconds to download, you’re not getting the high-quality .wav originals.6. Vimeo, for example, currently recommends 2-channel stereo audio exported using the AAC-LC (Advanced Audio Codec) at 320 kbit/s and a 48 kHZ sample rate. However, if you’re shooting broadcast or large format, you’ll need to check to make sure your export settings will match up.7. Review and Sign-OffAs with the beginning reviews and sign-offs of working with corporate video clients, you’ll need to be aware of the same issues when finishing up your drafts and exporting your final deliverables. I can tell you from experience that a project is never really over until every relevant party has seen and reviewed the final draft.
